This policy applies to:
- All tutors contracted or employed by CBC Education.
- All clients (students and/or parents) receiving tutoring services.
- Any third parties involved in the delivery or facilitation of tutoring services.
3. Definition of Disintermediation
Disintermediation refers to any attempt by a tutor or client to circumvent CBC Education by arranging tutoring services directly, outside of the agreed contractual framework. This includes:
- Direct payment arrangements.
- Scheduling sessions outside CBC Education’s systems.
- Sharing personal contact details for future direct engagement.
4. Policy Statement
CBC Education prohibits any form of disintermediation. All tutoring services must be arranged, delivered, and paid for through CBC Education. This ensures:
- Compliance with safeguarding and safer recruitment protocols.
- Proper vetting and monitoring of tutors.
- Accurate record-keeping and accountability.
- Legal compliance with UK employment and agency regulations.
5. Tutor Obligations
Tutors must:
- Not solicit or accept direct engagements from CBC Education clients.
- Report any attempts by clients to bypass CBC Education.
- Maintain professional boundaries and use only CBC Education-approved communication channels.
6. Client Obligations
Clients must:
- Not attempt to engage tutors directly outside of CBC Education.
- Use CBC Education’s systems for scheduling, communication, and payment.
- Report any solicitation by tutors for direct engagement.
7. Consequences of Breach
Any breach of this policy may result in:
- Termination of tutoring contracts.
- Removal of access to CBC Education services.
- Legal action for breach of contract or regulatory non-compliance.
8. Safeguarding and Legal Compliance
This policy supports CBC Education’s safeguarding framework and complies with:
- Keeping Children Safe in Education (KCSIE).
- Employment Agencies Act 1973.
- Conduct of Employment Agencies and Employment Businesses Regulations 2003.
9. Monitoring and Review
CBC Education will monitor compliance with this policy and review it annually or in response to changes in legislation or business practices.
10. Contractual Clauses
For Tutors:
Tutors agree not to engage in any direct arrangements with CBC Education clients outside of the organization’s systems. Any such engagement will be considered a breach of contract and may result in termination and legal action.
For Clients:
Clients agree to use CBC Education’s systems for all tutoring services and not to engage tutors directly. Any attempt to bypass CBC Education may result in termination of services and legal recourse.
